The state is experiencing one of the highest foreclosure rates in the nation. Many people are still facing a crisis today. The Project offers borrowers a resource that they can turn to for legal advice and assistance from well qualified lawyers and housing counselors.
Local non-profit law firms, the Florida Housing Finance Corporation, and other local agencies have partnered together to create this program. They are responding to the crisis that is facing the state by providing residents with high-quality, free legal assistance and representation. This is being made available to those homeowners who are faced with losing their home to foreclosure.
In addition to the legal advice and court representation, the Mortgage Foreclosure Defense Project also works closely with the Florida Housing Finance Corporation. This organization provides mortgage and housing counselors to homeowners. Together they will review the individuals financial situation and explore all alternatives to foreclosure.
They offer people numerous solutions. These can include payment assistance, repayment plans, mortgage loan modifications, special forbearance, waiving fees, refunding, private sales and compromise sales. Or the organization can provide applications to and information on the numerous federal government sponsored programs. In addition, the Project will also assist homeowners who may potentially lose their home due to unfair practices by contractors or predatory lending. Lawyers that are part of the program will try to prevent the loss of homes due to lien foreclosures, supporting the retention of assets by low income residents and preventing their downward spiral into poverty and/or homelessness.
In addition, the lawyers from the Project will also use the local Florida court system to protect elderly families and individuals as well as low income families from predatory lenders. Unfortunately these groups have historically been the prime targets of various forms of illegal predatory lending, questionable mortgages, and other unfair practices by lenders and banks.
Predatory lending is typically defined as the practice of deceptively convincing borrowers to agree to unfair, high priced and abusive loan terms. Or in some cases lenders may be systematically violating the mortgage terms in ways that make it difficult for the borrower to keep up with their payments, or defend against these illegal practices. Often the goal of such lenders is to unfairly obtain ownership of a person's home, rather than receive the normal payment of interest and principal.
Lawyers that are part of the Mortgage Foreclosure Defense Project will help prevent the loss of homes by helping these families and individuals rescind unfair mortgages, reduce interest rates, negotiate more favorable terms, and eliminate finance charges and other fees. They will also use the services of HUD counselors and use the judicial system if and when needed.
