Under Pennsylvania’s Utility Service Tenants Rights Act, I am entitled to a 30-day notice before any termination when the account is in the landlord’s name. I received no notice whatsoever. I recorded the call with official Paula, extension 230 who outright stated to me when I respectfully explained that no notice was mailed to me, the tenant, as required by law, therefore the termination was not proper and lawful. Paula had no desire to hear what I had to say and responded with her outright admission to BFMA not following the State Laws, specifically: Under 66 Pa. C.S. § 1521 et seq., termination without notice to the tenant is unlawful.
Paula's exact admission was: " Yeah well we don't do that we never have."
Also, I stated that according to local laws and ordinance of New Brighton, PA. All Water & Sewage bills must remain in the Landlords/Homeowners name, and that the landlord is ultimately responsible for making the payments. All landlords that have tenants living in the home, must pay the water and sewage bills and then work out repayment from the tenant.
Paula also admitted to speaking with the Landlord and being informed by the Landlord that "they received no notice, but you know, they all say that ".
When Paula admitted this, I confirmed that not only does the BFMA not send out the proper 30-day notice to the tenant, but the landlord has not sent any bills or notices to the tenant.
Paula had no desire to attend. Matter of fact, when discussing how by local laws and ordinance the Landlord whose name the utility is in is responsible for the bill ultimately. Paula instead had this to say " yeah well, you could move out in the middle of the night, leaving them stuck with the bill so, you know, ultimately you are going to have to make the payment before 3:30 so I can restore your services. "
I have two young children, both under 5 years old, and this situation is an immediate health and sanitation emergency. I also have a teenage daughter who had to be absent from school today due to unsanitary conditions and having no way to bathe or prepare for school.
I am requesting that water service be restored immediately and that the account be placed in emergency review for improper shutoff.
Problem is the Municipal Authority is not in the PUC'S jurisdiction and basically has no oversight besides a "board of directors " whose contact information is NOT made available to the public regarding serious issues such as this.
If you can assist me with what to do, where to turn. Because I can't even wash my toddlers supplies and things are getting very unsanitary. That is not how I live. Please.
