Hi. My name is Keri. I am 41 years old and live in Albuquerque. I have squamous cell carcinoma tumor / * cancer along with many other medical problems. I am fully disabled. I was receiving radiation and chemotherapy treatment 5 days a week until the radiation developed a Fistula and I they decide to do surgery to remove the tumor. The tumor was too large so I ended up with a colostomy. I am now back to getting radiation and chemotherapy 5 days a week.
I live in Albuquerque Bernalillo County and my radiation is in University NM and my chemotherapy is far along with many other doctor appointments in between. I am unable to drive so my boyfriend has quit his job to take me to all my appointments. I live off disability and barely make it as it is. Can you please help me? I am not going to be able to continue my appointments if I don't get some help. I am in desperate need of financial help. Most of the time I have nothing to even eat. My doctors are starting to turn me away because I don't have my copayments. I can no longer afford the fuel to get back and forth to my treatments. Please help.

I am writing to request urgent legal advocacy and intervention regarding the City of Albuquerque’s clear negligence, repeated denial of mandated emergency relief, and ongoing obstruction of my rights as a disabled resident and public records requester.
### 1. **City Liability and Hazardous Conditions**
On May 10, 2025, I sustained catastrophic, permanent injuries at the Los Altos BMX Pump Track due to the City’s negligent design and maintenance. The track contains unmarked, unpainted boulders within the ride zone—hazards that were neither reasonably visible nor warned against. My collision with these rocks resulted in eight permanent disabilities, as confirmed by attached medical records and imaging. Numerous other riders, including children, have suffered similar injuries, demonstrating a pattern of public safety failure.
Despite providing the City with comprehensive documentation—including hospital records, specialist reports, and community witness statements—the City has refused to accept responsibility or engage in good-faith settlement discussions.
### 2. **Failure to Provide 72-Hour Relief Funding—Twice**
Following my injury and loss of income, I applied twice for the City’s 72-hour emergency relief funding, submitting all required documentation each time. Both applications were either ignored or denied without explanation, despite my clear eligibility as a disabled resident in urgent crisis. This failure directly violates the City’s own emergency relief protocols and has compounded my family’s financial hardship.
### 3. **Denial of My Case and Suppression of Evidence**
The City has not only denied my requests for emergency relief and support but has also obstructed my lawful Inspection of Public Records Act (IPRA) requests for evidence needed to support my tort claim. As detailed in my formal complaints (attached), the City has:
- Delayed or refused to process records requests unless I prepaid for unnecessary physical media, in violation of state law;
- Denied the existence of surveillance footage and other critical records, despite public documentation confirming their existence;
- Engaged in a pattern of administrative retaliation and evidence suppression, raising serious concerns of spoliation and civil rights violations under 42 U.S.C. § 1983.
### 4. **Impact on My Family**
As a result of the City’s negligence and administrative obstruction, I am permanently disabled, unable to work, and at imminent risk of losing our home. My wife and three young children now face housing and food insecurity, mounting medical bills, and ongoing trauma.
### 5. **Requested Action**
I respectfully request that Disability Rights New Mexico:
- Investigate the City of Albuquerque’s failure to provide required emergency relief and their denial of my case;
- Advocate for immediate emergency assistance and ensure the City is held accountable for its obligations to residents with disabilities;
- Assist with legal action or appeals regarding both the City’s negligence and their ongoing suppression of evidence and denial of public records.
