How can I refi my mortgage if my loan is more than my mortgage?

You can't refinance if your home price is down and less then mortgage. The only choice you have is to modify your mortgage. And that can be done and save you money every month on your mortgage payment.

That is tough. Modification can work. Using a counselor may work. Tough to refinance yourself though without help.
